SET UP A TRUST ACCOUNT

The Maine Trust for People with Disabilities offers two types of trust accounts:

MTPD Trust #1 - Funded by the family of the individual with a disability

A trust account funded with assets owned by parents or other family members. This type of account cannot be funded with assets owned by the individual with disabilities.

To set up an account in MTPD Trust #1 for a Maine resident who has a family member with a disability, you and your attorney should carefully review each of these documents, which can be reviewed and printed by clicking on the links below:

• Joinder Agreement (Application to establish a new account) (must be completed and signed)
• Authorization to Release Information (must be completed and signed)
• Social Security Administration Consent for Release of Information (must be completed and signed)
• Fee Schedule
• Master Trust Agreement
• Approval Letter from the Maine Department of Health and Human Services
• Approval Letter from the Social Security Administration

Where to Find Help

For assistance in understanding and completing the forms, families are encouraged to contact a Maine social service agency that appears on the list of Supporting Members of the MTPD. Staff workers at each Supporting Member agency have been specially trained to assist families who are interested in opening an account with the MTPD.

In addition to completing the forms, you should also contact your attorney to review the documents and prepare any additional documents needed, such as a Last Will and Testament if you wish to fund the account on your death. If you do not currently have an estate planning attorney, you can obtain a referral from the Lawyer Referral Service of the Maine State Bar Association at (207) 622-1480 or toll free at (800) 860-1460 or at their web site.

MTPD Trust #2 - Funded with Assets Owned Only by the Individual with a Disability

A trust account funded with assets owned only by the individual with disabilities. This type of account cannot be funded with assets that are owned by family members or any person other than the individual with disabilities. For example, if an individual with disabilities is entitled to receive an inheritance or an insurance settlement, the MTPD Trust #2 can be used to hold such funds.

To set up an account in MTPD Trust #2 for a Maine resident who has a disability, you and your attorney should carefully review each of these documents, which can be reviewed and printed by clicking on the links below:
